Introduction and agreement of the terms of use

The page “waterdragonarts.com” including all provided services, programs and courses (in this statement referred to as “the services”) is operated by Marco Lück. Only when the users, members, registered persons or visitors (referred to as “you”) agree to the terms and conditions stated below, may they engage in the use of the services provided. These include all online courses, paid or unpaid video material, pictures, articles, texts and other content such as blog posts and the online academy. We (Marco Lück and associated entities with waterdragonarts.com) reserve the right to make changes to these terms and conditions at any time without giving notice to you. Please be advised that it is your responsibility to review these terms and conditions regularly to make sure you are up to date with any possible changes.

Liability and advice for usage

You acknowledge that all exercise involves a risk of personal injury. Qigong and Taijiquan involves internal energy work and therefore requires a cautious and self-aware approach. You agree to take responsibility for your health and well-being in relation to all services provided on this page.

Ownership and copyright

All content, public or within any paid service, is protected by copyright law. Removing, altering or copying of any videos, blog articles, pictures as well as other design elements (such as pictograms or icons) is not permitted. The use of our service is for lawful, personal and non-commercial purposes only.

Health and medical conditions

You acknowledge that you should not practice when:

  • you suffer from a medical, mental or physical condition or disability that will or might increase the normal risks associated with exercise.

  • you are sick, extremely emotionally agitated, overly tired or don’t feel well in any other sense.

 You acknowledge that you should stop practicing (in the appropriate way), as soon as:

  • you suffer from any new injury, illness or other medical condition;

  • you feel any pain or discomfort beyond the typical sensation of sore muscles or exhaustion;

  • you feel that any exercise makes you feel nauseous, dizzy or unusually uncomfortable.

Payments

With purchasing the services you will gain immediate access to the course or content of the online academy. You authorize us to charge you the listed price. When joining the members area you agree to the monthly scheduled payment of the membership fee. If your scheduled payment fails you will automatically loose access to our services until you have paid the due balance. If you have signed up for a free trial or with a discount code, your first full payment will be charged 1 month after the sign-up date unless you cancel the membership before the new billing cycle starts. (Note: When canceling you loose you access immediately) By purchasing our separate courses (one-time payment) you will gain all-time access to the allocated course page.

Cancellation and refunds

The membership can be canceled immediately and at any time. With your cancelation you will loose your access to our services immediately. Refunds are not given for any courses or for unused days of the recent month or billing cycle (membership). We reserve the right to terminate your membership without any further notice if we find that your behaviour is not according to these terms of use.

Accountability

It is not permitted to share or transfer your account details (log-in details) with other people. The passwords of the courses are to be treated confidential and sharing is not permitted. We reserve the right to change the passwords of the course access page at any time without further notice. An email with the updated passwords will be sent to each customer for a continues access. You agree that it’s your responsible to make sure that emails from info@waterdragonarts.com are sure to reach your primary inbox to receive the information about any possible changes.

No representations or warranties

To the maximum extent permitted by applicable law and subject to the section below, all representations, warranties, undertakings and guarantees relating to waterdragonarts.com are excluded. To be successful with this practice you will require a lot of training, patience, perseverance. We know you can do it!

Limitations and exclusions of liability

I will not be liable to you in respect of any personal injury (including without limitation serious injury or death) that you may suffer or sustain directly or indirectly as a result of attending our program and courses. Nor will I be liable to you in respect of any other losses arising as a result of any such personal injury.

Sever-ability

If a section of this disclaimer is determined by any court or other competent authority to be unlawful and/or unenforceable, the other sections of this disclaimer continue in effect. If any unlawful and/or unenforceable section would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the section will continue in effect.

Law and jurisdiction

This disclaimer shall be governed by and construed in accordance with German law, and any disputes relating to this disclaimer or this Qigong course will be subject to the exclusive jurisdiction of the court of Germany.
